These Terms of Service (“Terms”) are an agreement between you and Social Esti (“Social Esti,” “we,” “us,” or “our”). They apply to our website, socialesti.com, and to the software, AI receptionist, websites, and done-for-you marketing and content services we provide (together, the “Services”). By buying a plan or service, or by using the Services, you agree to these Terms. If you are agreeing on behalf of a business, you confirm that you have authority to bind it.
1. The Services
Social Esti provides subscription plans that may include an AI receptionist (EstiVoice), online booking, a client CRM, a website, automatic review requests, and done-for-you email and text campaigns, as described on our Plans page for the plan you choose. We also offer one-time services, such as Brand Identity and Content Day. We set up the Services for you based on the information you give us. We may improve or change features over time.
2. Your account
You must be at least 18 and able to enter a binding contract. Give us accurate, complete information and keep it up to date. Keep your login details secure. You are responsible for activity under your account, and you should tell us right away at [email protected] if you think your account has been accessed without permission.
3. Subscriptions and billing
- Plans are billed monthly, in advance, through Stripe. By subscribing, you authorize us to charge your payment method each month until you cancel.
- Prices are shown on our Plans page. We may change prices for future billing periods and will give you notice before a change applies to you.
- October promotional rate: if you signed up for the Oct Starter Promo by October 31, 2026, you keep the $97/mo rate for as long as your subscription stays active. If you cancel, the promotional rate ends, and current pricing applies if you sign up again later.
- You are responsible for any taxes that apply. If a payment fails, we may pause or suspend the Services until it is resolved.
- Some usage, such as phone and text messaging, may be subject to carrier rules and limits.
4. Cancellation
You can cancel anytime. To cancel, email [email protected]. Cancellation takes effect at the end of your current billing period. You keep access until then, and you won’t be charged again after that.
5. No refunds
All payments are final. We don’t offer refunds on payments already made, including partial months, unused time after you cancel, and one-time services such as Brand Identity and Content Day.
6. One-time services
One-time services, such as Brand Identity, Content Day, and Content Day: Team, are scheduled after payment. We will work with you to agree on dates and details. You agree to provide the information, access, and availability we reasonably need to complete the work.
7. Your responsibilities
- Provide accurate information about your business, services, pricing, and policies, and tell us when it changes.
- Use the Services only for lawful purposes and in line with these Terms.
- Consent and compliance. You are responsible for getting and keeping any consent required from your own customers before they are contacted by text, email, or phone through the Services, including consent for automated or AI-handled calls and messages. You are responsible for complying with laws that apply to your communications, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, carrier and A2P 10DLC requirements, and state laws, and for honoring opt-out requests.
- Make sure you have the rights to any content, images, and logos you give us to use.
- Review and approve your marketing content and website as we ask you to, and tell us promptly about anything that needs correcting.
8. Acceptable use
You agree not to use the Services to:
- send spam, or contact people without the required consent;
- send content that is unlawful, deceptive, harassing, hateful, or that infringes anyone’s rights;
- make false or misleading health, medical, or results claims;
- interfere with, overload, or try to gain unauthorized access to the Services or any related systems;
- resell or provide the Services to others without our written permission.
We may suspend or remove content or accounts that violate these Terms.
9. Third-party services
The Services rely on third-party providers, including our CRM and website platform (LeadConnector / HighLevel), Stripe for payments, and phone and SMS carriers. Your use of those services may also be subject to their terms. We are not responsible for third-party services, and we don’t guarantee that the Services will be uninterrupted, error-free, or available at all times. Carriers may filter, delay, or block messages.
10. AI receptionist limitations
EstiVoice is an automated AI receptionist. It can make mistakes, misunderstand callers, or give incomplete answers, so you should review its setup, call logs, and bookings regularly. It is not for emergencies and does not give medical advice. It is not a substitute for a licensed professional, and callers with emergencies should call 911. Calls handled by EstiVoice may be recorded and transcribed to provide the service, and you are responsible for any notice or consent your callers need under the laws that apply to you.
11. Intellectual property
- Your content. You own the content you give us, such as your logo, photos, text, and client data. You give us permission to use it only to provide the Services to you.
- Content we create for you. Content we create specifically for you, such as your brand identity files, Content Day photos and video, campaign copy, and website copy, belongs to you once it has been paid for in full.
- Our platform. Social Esti, EstiVoice, our software, templates, workflows, and know-how remain ours or our licensors’. These Terms don’t transfer them to you, except for your right to use the Services while you are subscribed.
12. Disclaimer of warranties
The Services are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t promise any specific results, such as a number of bookings, calls, reviews, or revenue.
13. Limitation of liability
To the fullest extent allowed by law, Social Esti will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities. Our total liability for any claim related to the Services or these Terms is limited to the fees you paid us in the three (3) months before the event that gave rise to the claim.
14. Indemnity
You agree to defend, indemnify, and hold harmless Social Esti and its owners, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, your communications with your customers, or your violation of these Terms or the law.
15. Termination
You can end these Terms by canceling as described above. We may suspend or end your access to the Services if you don’t pay, if you violate these Terms, or if required by law or by our providers. If we end the Services for our convenience, rather than because of a violation or non-payment, we will give you reasonable notice. Sections that by their nature should survive termination, including payment obligations, no refunds, intellectual property, disclaimers, limitation of liability, and indemnity, will survive.
16. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and update the effective date, and we will give notice of significant changes. If you keep using the Services after changes take effect, you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of the state where Social Esti is organized, without regard to its conflict-of-law rules.
